The following terms and conditions apply to all transactions via the website Simitra's Exquisite Things. Use of the Simitra's Exquisite Things site and placing of an order indicates your acceptance of these terms and conditions. These terms are subject to change at any time. Changes will take effect on the date they are visible on the Simitra's Exquisite Things website. Please read them carefully and print a copy for future reference.

Simitra's Exquisite Things will endeavour to ensure the accuracy of all information made available on the web site. However neither Simitra's Exquisite Things nor any directors, employees or other representatives will be liable for damages of any kind arising out of or in connection with the use of this site. Prices and availability information are subject to change without notice. All goods remain the property of Simitra's Exquisite Things until paid for in full. By purchasing a product you are agreeing to these Terms and Conditions.

We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

Acceptance of your order and completion of the contract between you and Simitra's Exquisite Things will take place upon dispatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it.

The total price payable for the goods will be stipulated at the time when you place your order whether or not the order has been confirmed. Prices may be subject to change in some circumstances. In all cases we will inform you of the correct price and give you the opportunity to cancel the order.

Placement of an order with Simitra's Exquisite Things is not an a confirmation of our acceptance of your order. Only when a payment has been debited from your account and a confirmation of order processing and dispatch email has been sent to you; have we accepted and processed your order.

Emails received upon placement of an order are confirmation that we have received your order only. This is not confirmation that your order has been accepted by Simitra's Exquisite Things.

1:  DESCRIPTIONS

1.1:  We make every effort to provide an accurate description of each item, along with detailed representative photos or scans of any flaws or any damage.

1.2:  It is important to read the description carefully before buying and to ask questions where there is any doubt as to what is being shown. We pride ourselves upon giving clear and full descriptions and measurements. However, in the world of antiques and vintage items differences of opinion can arise over such subjective imponderables as condition. One person’s patina may be another person’s tarnish.

1.3:  Please contact us with any queries before buying, and we will try to provide relevant information or more pictures where necessary.

2:  ANTIQUE, VINTAGE AND ETHNIC ITEMS – CONDITION

2.1:  Some items are of ethnic or tribal handmade manufacture and irregularities are a feature of this process rather than flaws.

2.2:   Most of our stock is antique or vintage, which means that the items have been used, and are not pristine. Vintage items often show signs of wear or former ownership such as initials or pawnshop markings, usually on the back. These are part of the history and patina of the piece, and are often a natural part of the ageing process. This patina is what true collectors of antique pieces appreciate about them, because it tells a story.

2.3:  All major problems that we can see with a piece are noted in the description, but few antique pieces are perfect. We do try to note any breaks or lack of stability in our descriptions. However please remember that as many of these pieces have considerable age to them and may require far greater care in handling than a piece of modern jewellery. Unlike new merchandise antique and vintage items do not carry a warranty of being free from defect for a set period. The hair ornaments listed in our “Antiques" and "Vintage” (pre 1990) categories are offered as collectable vanity items only. While some of these items may be wearable with extreme care, no warranty to this effect is either given or implied. Consequently we are not responsible for any subsequent damage resulting from wear, use or (mis)handling after purchase and safe arrival. No compensation or refund can be considered in such cases.

2.4:  If you like your items perfect and pristine and do not wish to be troubled with having to handle them gently then vintage jewellery and hair ornaments are not for you, so please select from our BRAND NEW category. New hair ornaments and accessories are guaranteed to be free from defect, and if broken in normal wear within 30 days of receipt will be replaced, or a refund/store credit will be issued on production of suitable photographic evidence.

3:  CONTACT INFORMATION

3.1:  Queries and enquires are usually answered within 24 hours excluding weekends when our response may be slower.

3.3:  It is the sole responsibility of buyers to ensure that postal addresses (including zip or postal code) supplied to us are correct in every respect and fully up to date. We will not accept responsibility for missing packages or errors arising from buyer's failure in this respect or for reimbursement of any ensuing expenses, including compensation for postal loss/damage, excess postal fees, or other charges arising directly from supply of erroneous information.

4:  PAYMENT OPTIONS

4.1:  UK Buyers: Paypal, credit/debit card, personal or business check, bank transfer or postal order. Personal checks from new customers may be held for clearance – usually 5-7 business days.

4.2:  International Buyers:  We prefer Paypal or credit/debit card payment. We also accept the following: Cashier/bank checks and US dollar and EURO personal checks, money orders by mail. Money orders need not be international.  Other methods such as international bank transfer can be made by arrangement, but buyer pays any associated charges and fees. We also accept Western Union money transfer.

4.3:  Items purchased will initially be placed ON HOLD for seven working days to allow buyers to make payment arrangements or for funds to clear our account.

4.3:  Customers who do not pay by Paypal/Credit/Debit Card MUST contact us within THREE working days to arrange a payment method. Mailed payments must reach us within SEVEN working days (UK buyers) or FOURTEEN working days for international buyers. If you cannot meet these terms we will try to be flexible and work with you but only if you CONTACT us to explain the problem. If you do not maintain contact we reserve the right to re-list items after 14 working days. (Working days do not include weekends or UK holidays).

5: SHIPPING, INSURANCE, AND HANDLING FEES

5.1:  We will ship to any country in the world. However, we reserve the right to restrict the forms of payment we are prepared to accept and to vary other trading terms when dealing with certain areas as an anti fraud precaution measure.

5.2:  UK SHIPPING: all items mailed first class.  For ALL items over £30 insured/signed for delivery is required. For large heavy items we use Royal Mail Parcels or Parcelforce.

5.3:  INTERNATIONAL SHIPPING: We use small packet air shipping unless item is large, heavy or bulky. Tracking & insurance are mandatory on ALL items valued at $100 or more.

International shipping times vary but the following is an approximation:

Mainland Europe/EU: 4-7 working days
USA/Canada: 7-10 working days
Rest of the World: 7-14 working days

5.4:  Our S/H charge includes the use of good quality packing materials with plenty of peanuts and bubble wrap where appropriate, because we want your item to reach you in good condition.

5.5:  We are happy to combine shipping on multiple purchases for both UK and International buyers but shipping costs for single items are strictly non-negotiable. For combined shipping items must be purchased within 7 days and paid for and shipped as a batch. Some items may not conveniently be shipped together because of their size or format and may require special packaging.

6: SHIPPING DAMAGE OR LOSS

6.1: In the rare instance of lost parcels or items which arrive damaged, we will assist you to apply for financial compensation as follows:

6.2:  Where buyer has purchased insurance we will initiate a claim with Royal Mail/carrier or our insurers on buyers behalf. Refund will be given by same means as payment received wherever practicable.

6.3:  Where buyer has declined insurance items are conveyed at buyers own risk and we can accept no responsibility for missing or damaged goods.

6.4:  Buyers should examine items immediately on arrival for any damage suffered in transit or significant defects that have not been provided for in the description. All such damages or defects MUST be notified to us within 24 hours of receipt. Evidence may be required. Outside this time frame the buyer will be deemed to have accepted the item.

6.5:  Antique and vintage items are sold without warranty. We are not responsible for items which arrive safely and are subsequently damaged through wear or (mis) handling.

6.6:  Items described as "new" and which become defective in normal wear or use within 30 days of receipt will be replaced or refunded. Evidence may be required.

6.7:  For claims of damaged or effective on arrival buyers may be required to produce evidence of date received (e.g. original packaging with postmark, etc) or notification to ourselves (copy of email with all headers) that such conditions have been fulfilled. Photographic evidence of damage or return of item may also be required.

6.8:  For claims of postal loss our insurers will only consider claims on production of evidence. Buyers may be required to produce evidence from their postal service that the item had been investigated and pronounced lost. Alternately buyers may complete a “declaration of non-receipt” which may be accepted by our insurers.

7:  RETURNED ITEMS AND UNCOLLECTED MAIL

7.1:  If a package is returned to us because buyer failed to collect it from the post office, sorting depot, etc or to make appropriate re-delivery arrangements then any excess postal charges which are necessary to resend the item must first be met by the buyer before the item can be re-dispatched. Should buyer refuse to pay the appropriate shipping cost for redelivery within 7 days we will terminate the transaction and refund as follows: item price only less 25% restocking charge to cover our time and expenses in dealing with the matter.

7.2:  To return an item buyers must first contact us to obtain a “returns number”. Returns are at buyers expense unless the item was damaged or defective (evidence required) in which case return shipping cost will be refunded. We do not refund shipping cost for items returned for “buyer remorse” or because it was no longer required.

7.3:  In order to comply with our refunds policy items must be returned at buyers expense in *same condition as sent* by secure/trackable means within 7 days (for UK buyers) and 14 days for buyers outside UK. This provision is in accordance with the EU Distance Selling Regulations (2000). Once the appropriate time frame has passed no refund can be made and the buyer will be deemed to have accepted the item.

7.4:  Claims for items which are damaged or lost during return are the responsibility of the sender.

7.5:  Buyers who reject a full refund or decline or fail to return an item or provide acceptable evidence of loss, postal damage or defect within the appropriate time frame forfeit all claims to refund or redress.

7.5: Items which are returned damaged, altered or repaired (except where buyer has established to our satisfaction that such damage resulted in transit) cannot be refunded.

7.6:  Buyers who reject a full refund or decline or fail to return an item or provide acceptable evidence of loss, postal damage or defect within the appropriate time frame forfeit all claims to refund or redress.

7.7:  Owing to attempted fraudulent abuse of this facility in the past it is no longer our policy to offer “partial refunds” except in very exceptional circumstances.

7.8:  We refund shipping only in EXCEPTIONAL circumstances, where we agree that the item was SUBSTANTIALLY misrepresented in our description. In the rare cases where we agree to refund return shipping we will only do so upto the cost which we ourselves initially incurred in sending the item to buyer. If buyer chooses to return item/s by a more expensive method (e.g. courier) then they must bear this cost themselves. International packages must be clearly marked on customs form as "returned goods". Any "brokerage" fees or customs duty which might be incurred by us in accepting such returned merchandise will be deducted from any refund due. When an item was sent as part of a batch with discounted shipping and buyer wishes to return only part of a batch or a single item we do not refund shipping expenses because it is not convenient to determine what part of shipping expenses would apply to any individual item.

7.9:  In the case of all refunds/returns (other than for substantial misrepresentation, postal loss or damage) that we might agree to accept these are dealt with on a case-by-case basis and are based upon the requirement that the buyer pays return shipping by insured/traceable means and the goods are returned in the same condition as sent. In the case of returned goods which are recieved damaged and unsaleable we reserve the right not to refund, to discard the item and regard the matter as concluded.

7.10:  Any financial settlement (other than for substantial misrepresentation, postal loss or damage where insurance has been taken out) may involve refund of the original bid price (no shipping) subject to a deduction of all Paypal fees associated with the original transaction plus a restocking fee of up to 25% to cover our time, inconvenience and costs in relisting the item.

7.11:  Wherever possible all refunds will be made to the buyer by the same means as original payment. Where this proves to be unworkable payment method to be at our absolute discretion.

8:  PRODUCT AND SERVICES AVAILABILITY

8.1:  All products and services are subject to availability and may be withdrawn at any time. If Simitra's Exquisite Things cannot supply the goods for any reason we will not charge you for these and we will refund any money already paid for them. However, Simitra's Exquisite Things will not be responsible for compensating you for any other losses you may suffer if we do not supply the goods.

8.2:  Exchanges and/or substitutes may be offered to buyer in the rare cases where we are unable to supply items which have been ordered.

8.3:  It is not generally our policy to offer to “buy back” items or to provide exchanges for those which were purchased “in error” by buyer once the 14 day returns period has elapsed. Any decision to do so and the terms to be offered or applied are purely concessionary and at our absolute discretion.

8.2: Special offer prices using codes or vouchers provided are available whilst stocks last. Simitra's Exquisite Things reserves the right to withdraw special offers at any time. Only one code/voucher can be used for any one purchase and codes cannot be exchanged for any monetary value. 

8.3: Discounts are applied automatically when available and are subject to our terms and conditions.

9:  PRIVACY POLICY

9.1:  Under the Data Protection Acts of 1984 and 1998, we follow strict procedures and do not disclose any customer information to third parties other than for delivery purposes. We do not sell, rent or trade your personal information to third parties for marketing purposes.

9.2: When you place an order the shopping cart collects your contact details (name, email address and telephone number) so that we can contact you if there is a problem with your order. We may also monitor usage of our website and customer traffic patterns as this helps us to continually improve our service. Occasionally we may email you with details of special offers and new products. If you do not wish to receive this information, please email sales as soon as possible.

9.3:  Cookies are small pieces of information that are stored on your computers hard drive by your browser. Like most websites, we may use cookies to keep track of the content of your shopping cart, to store delivery addresses if an address book is used, and to monitor traffic flow to our website. Our cookies do not track any personally identifying information.

Most browsers allow the cookie function to be switched on or off. This can be done by looking in the help menu on your browser.
